Below you will find the general terms and conditions of Tiny Thinkers B.V. These apply to all orders and contracts via our webshop.
Definitions
In these terms and conditions, the following definitions apply:
Entrepreneur: Tiny Thinkers B.V., established in Emmeloord.
Consumer / you: the natural person who does not act for purposes related to a business or profession, and enters into a contract with the entrepreneur.
Distance contract: a contract whereby up to and including the conclusion of the contract, only one or more techniques for distance communication are used, for example an order via the website.

Applicability
These general terms and conditions apply to every offer from Tiny Thinkers and to every distance contract concluded between Tiny Thinkers and you.
Before the distance contract is concluded, the text of these general terms and conditions will be made available to you. If this is not reasonably possible, Tiny Thinkers will indicate before the contract is concluded how you can view the general terms and conditions.
If any part of these terms and conditions is declared null or invalid, the rest of the terms and conditions will remain in effect.
If you have complaints, you as a consumer should first contact the entrepreneur. If the webshop is affiliated with WebwinkelKeur and complaints cannot be resolved through mutual consultation, you can contact WebwinkelKeur (www.webwinkelkeur.nl), which will mediate free of charge. You can check whether this webshop has an active membership via webwinkelkeur.nl/leden. If no solution is reached, you have the option to have your complaint handled by the independent dispute committee appointed by WebwinkelKeur. The decision of this committee is binding, and both entrepreneur and consumer agree to this binding decision. There are costs associated with submitting a dispute to this committee, which must be paid by the consumer to the relevant committee.
The offer
Tiny Thinkers does everything possible to present products and services as clearly and truthfully as possible. Any mistakes or errors in the offer do not bind Tiny Thinkers.
Obvious mistakes or errors in the offer, for example in prices, product descriptions, or images, do not give you the right to enforce an agreement.
Each offer contains such information that it is clear to you what your rights and obligations are connected to the acceptance of the offer.
The agreement
The agreement is concluded at the moment you accept the offer and meet the conditions set.
If you have accepted the offer electronically, Tiny Thinkers immediately confirms receipt of the acceptance electronically. As long as the receipt of this acceptance has not been confirmed, you can dissolve the agreement.
If the agreement is concluded electronically, Tiny Thinkers takes appropriate technical and organizational measures to secure the electronic transmission of data and ensures a secure web environment with SSL encryption.
Tiny Thinkers may, within legal limits, verify whether you can meet your payment obligations, as well as all facts and factors relevant to responsibly entering into the distance agreement. For justified reasons, Tiny Thinkers has the right to refuse an order or attach special conditions to its execution.
Right of withdrawal (reflection period)
You have the right to withdraw from the agreement within 30 days without giving any reason. The reflection period starts the day after you receive the product.
Within this period, you must notify us of the withdrawal (return notification). After you have done this, you have another 14 days to actually return the product. We will then ensure that the refund takes place no later than 14 days after the return notification.
During the reflection period, you must handle the product and packaging carefully. You may only unpack or use the product to the extent necessary to determine the nature, characteristics, and functioning of the product.
If you exercise your right of withdrawal, you must return the product with all supplied accessories and, if reasonably possible, in the original condition and packaging to Tiny Thinkers.
Obligations of Tiny Thinkers upon withdrawal
If you notify Tiny Thinkers of the withdrawal, Tiny Thinkers will send you a confirmation as soon as possible.
Tiny Thinkers will refund the paid purchase amount and any standard shipping costs as soon as possible, but no later than 14 days after withdrawal, provided the product has been returned in good condition.
Tiny Thinkers uses the same payment method for refunds that you used, unless you agree to a different method. This refund is free of charge for you.
Exclusion of the right of withdrawal
In some cases, you cannot exercise the right of withdrawal. This applies, among other things, to:
Hygiene: products that cannot be returned for hygienic reasons and whose seal has been broken after delivery.
Custom-made: products made according to your specifications.
Digital content: audio, video recordings, and computer software whose seal has been broken after delivery.
The price
The prices stated in the offer include VAT, unless otherwise specified.
Any shipping costs or other additional charges are clearly stated during the ordering process, so you always know the total costs in advance.
Conformity and warranty
Tiny Thinkers guarantees that the products and services comply with the agreement, the specifications stated in the offer, reasonable requirements of quality and usability, and the legal provisions existing on the date the agreement was concluded.
Any additional warranty offered (manufacturer's or supplier's warranty) does not affect the legal rights you have as a consumer.
Delivery and execution
Tiny Thinkers will exercise the greatest possible care when receiving and executing orders.
The place of delivery is the address you have provided to Tiny Thinkers.
Tiny Thinkers strives to execute orders as quickly as possible, but no later than within 30 days, unless another delivery time has been agreed upon.
In case of delay in delivery or if an order cannot be executed or only partially executed, you will be notified no later than 30 days after placing the order. In that case, you have the right to dissolve the agreement without costs and the right to any compensation if you are legally entitled to it.
Payment
Unless otherwise specified in the agreement or additional terms, the amounts you owe must be paid within 14 days after the cooling-off period begins, or if there is no cooling-off period, within 14 days after the conclusion of the agreement.
If advance payment is required, you cannot assert any rights regarding the execution of the relevant order or service(s) before the agreed advance payment has been made.
You are obliged to report any inaccuracies in the provided or stated payment details to Tiny Thinkers immediately.
Complaints procedure
We recommend that you first report complaints to us by emailing info@tiny-thinkers.nl.
Complaints submitted to Tiny Thinkers will be answered within 14 days of receipt. If a complaint requires a foreseeable longer processing time, you will receive an acknowledgment within 14 days and an indication of when you can expect a more detailed response.
Disputes
Dutch law exclusively applies to agreements between you and Tiny Thinkers to which these general terms and conditions relate.
All disputes will be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
Additional or deviating provisions
Additional or deviating provisions from these terms must not be to your disadvantage. They must be recorded in writing and will be made available for inspection if necessary.
